Term of Service

1.                   Introduction:  Welcome to DailySolution.net.  The following are the terms and conditions for use of this DailySolution.net service.  If you have any questions regarding the services and/or these Terms, please use the “Question Form” to contact us.  
 

2.                   Definitions:  In terms and conditions that follow, the terms “user”, “you” and “your” refer to the individual or organization that creates a DailySolution.net account.  The term “Daily Solution” “we” “us” and “our” will refer to DailySolution.net.  The word “Term” will refer to terms or stipulations contained in this document.  Identities using the services on the website DailySolutions.net will be referred to as “Customer”.

3.                   Acceptance:  By using our DailySolution.net site in any way, you are agreeing to comply with and be bound by the following Terms listed on the DailySolution.net website.  Please review the following Terms carefully.  If you do not agree with the Terms or any of the related Agreements in their entirety, do not use the Service.  Your acceptance of these Terms is signified by your payment of the subscription to the DailySolutions.net website.

4.                   Subscription accounts and activities:  Any content provided by you on the site and your use of our Service shall not be illegal or violate any federal, state, or local law, statue, ordinance or regulation, create liability for us or cause us to lose business and conduct business competitive.  In addition, you are prohibited from soliciting users or assistants replying replies to your questions and/or problems.  DailySolution.net (Oasis Healthcare Services, LLC) may suspend or terminate your account if we suspect, in our sole judgment have engaged in fraudulent activity in connection with the Site or have engaged in activities in violating of these Terms or intend to use the information to harm a person, business or other entity.

5.                    Termination of Service and Refunds:  First months subscription $10 and the first order of questions not used at $3 per questions are refundable.  For example, if your first order with DailySolution.net is 5 questions at $15 and you use only two questions when you decide to terminate your account.  Your account will be terminated and you will be refunded $10 for the subscription and $3 for every unused question.  A check from Oasis Healthcare Services, LLC with an account statement of all activity will be refunded within 90 days of your termination notice.  This refund policy only applies to the first month subscription and the first order of questions.  SUBSEQUENTIAL SUBSCRIPTONS AND QUESTION ORDERS ARE FINAL.  Certificate purchases are final.  DailySolution.net (Oasis Healthcare Services, LLC) reserves the right to refuse or terminate service to anyone at any time without explanation or reason.  You will be refunded your purchase of unused questions at $3 per question.  Subscription will be refunded only if it is the first month of purchase.  No Certificates will be refunded.

If DailySolution.net has difficulty finding adequate information and resources to assist you with your question or problem, we may have to defer it and give you another one at no cost.  Our gage for success is three to five creditable resources to assist you with your question/problem.

You must submit your Termination of Service using the "Question Form".  The refund will be mailed to you approximately 90 days from your "Termination" e-mail.

6.                   Limitation of Liabilities:  In no event shall we, our parents, subsidiaries, officers, directors, employees or our supplies be liable for any indirect, special, incidental or consequential damages (Including lost profits or loss of business) arising out of or in connection with our site, our services or this agreement based on any theory, even if advised of the possibility of such damages.  The negation of damages set forth above is fundamental elements of the basis of the bargain between us and you.  This site and the information would not be provided without such limitations.  In no event will our liability, and the liability of our parents, subsidiaries, officers, directors, employees, and suppliers, to you or any third parties in any circumstance exceed the greater of (A) the amount of fees you pay to us in the 12 months prior to the action giving rise to liability, or (B) $100.  This applies for those residents of states that honor exclusion and/or limitation of incidental or consequential damages.

7.                   Indemnification:  You agree to indemnify, defend and hold DailySolution.net, Oasis Healthcare Services, LLC, subsidiary, or affiliate organizations, officers, agents and employees, harmless from any claim, demand, or damage, including reasonable attorneys’ fees, asserted by any third party that are in an way due to or arising out of your use of or conduct on the Service.  DailySolution.net shall provide you reasonable notice of such claim.

8.                   No Endorsement of Non-DailySolution.net and Oasis Healthcare Services, LLC  Entity:  Placement of information, logos, links or names of such non-DailySolutions.net entities on the DailySolution.net site does not constitute an endorsement or warranty of these entities , their products or services. Users take full responsibility for a decision to visit or patronize any such entity and hold DailySolutions.net harmless from any liability arising from such actions.  You further acknowledge that no relationship (such as partnership, agent, joint venture, or employee ) is created between you and DailySolution.net and Oasis Healthcare Services, LLC or between any user (customers and “Assistant”) or by your participation on this site.

                       
You are assuming the responsibility to evaluate the value, accuracy and applicability of all the referrals, websites, business, resources and information offered to you by DailySolution.net assistants.

9.            Disputes, Assignment, and Governing Law:  These Terms and the related agreements  constitute the complete and exclusive statement of the agreement between you and us.  If  supersedes any and all prior or contemporaneous agreement, oral or written, and any other  communications, representations, warranties and understanding relating to the subject matter of this agreement.  If there is a conflict between an oral representation of any DailySolutions.net employee or agent and the terms of this agreement, the terms of this Agreement will prevail.  To the extent that anything in or associated with the Site is in conflict or inconsistent with this agreement, the terms of this agreement will prevail.

This section titles in these Terms are solely used for the convenience of the parties and understanding of the Terms of the services included in this agreement.  Each party using our website or services agrees to the exclusive jurisdiction of the courts of the State of Nevada, and agrees that venue for any action resulting from this agreement or the use of our services shall be in Las Vegas, Clark  County, Nevada and waives any and all jurisdictional, venue or inconvenient forum objections.  You and DailySolution.net agree that any cause of action arising out of or related to this service must commence within one year after the cause of action arose; otherwise, such cause of action is permanently barred.  You may not assign this agreement to any other party.  DailySolution.net shall not be deemed to have waived any of our rights or remedies unless such waiver is in writing and signed by us.  No delay or omission on the part of DailySolution.net, in exercising any rights or remedies shall operate as a waiver of such rights or remedies or any other rights or remedies on future occasions.

10.          DailySolution.net service:  The service provided by DailySolution.net is intended to provide you with resources, referrals and/or information in the area of your question and/or problem.  The level of usefulness is subjective to your needs, desires, expectations and perception.  As a result, you are to consider DailySolutions.net reply to your  question/problem as an Assistant to you’re your decision making process. DailySolution.net does not intend to give you a decision, final solution, diagnoses, answer, selection, and commit.  DailySolution.net is NOT intended to replace a licensed, certified and/or specialist in the field in your question/problem area of interest.
